Karl Rove: Dick Durbin, the IRS, and Me

Many Democrats have fallen silent about letters asking for investigations. Not the senator.

Say this much for Assistant Senate Majority Leader Dick Durbin: He’s got chutzpah. Most congressional Democrats who wrote letters asking the IRS to investigate tea party and other 501(c)(4) conservative groups have fallen silent or are expressing feigned outrage that the IRS would do what they asked. But not Mr. Durbin.

This Sunday on Fox News, Chris Wallace asked the senator why he urged the IRS to investigate a conservative group operating as a tax-exempt organization under section 501(c)(4) of the tax code. Mr. Durbin not only acknowledged that he sent a letter asking the IRS to investigate the group in October 2010, but he defended his request, saying the group he wanted investigated was raising “millions of dollars.”

The group in question is Crossroads GPS. I know something about it. I’m not a director, officer or involved in the day-to-day activities of the organization, but I encouraged the group’s creation and help raise money for it as a volunteer.

Crossroads GPS is a 501(c)(4) advocacy group that builds grass-roots support for conservative policies that encourage economic growth, reduce needless regulation, promote fiscal responsibility and strengthen national security. Many policies that GPS has championed—for example, no cap-and-trade and a 2011 debt limit deal with spending caps and no tax increase—prevailed.

Mr. Wallace asked Mr. Durbin why he singled out Crossroads GPS for an IRS investigation and pointed out that his letter “did not mention one single liberal group.” Mr. Durbin offered this ludicrous defense: If the IRS investigated GPS, “every other group would be put on notice.” Correction: An IRS investigation of a conservative 501(c)(4) would leave liberal 501(c)(4) groups gleeful—especially since liberal groups have operated for decades in the same way GPS does without Democrats complaining.

Democrats were content to have 501(c)(4) groups active as long as they were operating on behalf of liberals and their causes. For example, no Democratic leader demanded the IRS investigate the 501(c)(4) arms of the League of Conservation Voters, National Abortion Rights Act League, VoteVets, NAACP, Defenders of Wildlife, Sierra Club and other liberal organizations that have spent millions excoriating Republicans, pushing liberal issues and registering voters.

When Americans United for Change ran ads in 2007 slamming Republican senators up for re-election for supporting the surge of additional U.S. troops in Iraq, no Democratic lawmaker complained. Nor did Mr. Durbin gripe in 2011 when Bill Burton, his former staffer and an Obama White House official, organized Priorities USA, a 501(c)(4) to help the president’s cause.

In addition, no Democratic leaders decried big money’s influence when groups registered under section 501(c)(5) of the federal code—the tax exemption for labor, agricultural or horticultural organizations—spent hundreds of millions from corporate treasuries on advocacy and political activity. That’s because Democrats believe unions are more deserving of tax-exempt status than other organizations, and that corporate contributions are bad unless they come from unions’ corporate treasuries.

Apparently my volunteering for Crossroads GPS didn’t sit well with Mr. Durbin, who grumbled on Fox News that I was “boasting about the money they were raising.”

Not so. A LexisNexis search and a look at my Fox News appearances and columns turned up only one “boast” by me about GPS’s fundraising. That occurred when I wrote in these pages on Oct. 13, 2010 that “[American] Crossroads and GPS have raised more than $14 million” in the two weeks after President Barack Obama smeared these groups by claiming they were funded with foreign contributions—a slander for which Team Obama never offered evidence. The problem for Mr. Durbin is that my comment appeared two days after he sent his letter to the IRS.

From the start, Crossroads GPS’s leaders were fully aware the group would be subject to intense scrutiny. As a result, they made compliance a priority. Every GPS program, expenditure and communication is legally vetted to ensure that it complies with the rulings and guidance the IRS has issued since tax-exempt groups were authorized in 1913.

What was going on is obvious: Mr. Durbin wanted the IRS to silence conservatives. So did every other congressional Democrat who wrote similar letters to the IRS, from Senate Finance Committee chairman Max Baucus to New York Sen. Chuck Schumer to Vermont Rep. Peter Welch. But in the glare of public attention, using the IRS to cripple or destroy opponents looks corrupt. Abuse of power always is.

Mr. Rove, a former deputy chief of staff to President George W. Bush, helped organize the political action committee American Crossroads.

DHS lost track of dangerous ‘illegal overstays’

Editor’s Note – When this story appeared an immediate question arose: if these people were so potentially dangerous, how did they get into the country anyway? With the Boston terror event less than seven weeks past, with all those red flags missed, what else is in the offing thanks to the DHS?

DHS Can’t Locate 266 Illegal Overstays that ‘Pose National Security’ Risks

(CNSNews.com) – The Department of Homeland Security (DHS) cannot find 266 potentially dangerous foreign nationals who have overstayed their visas, according to the Government Accountability Office (GAO).

According to testimony from Rebecca Gambler, director of the Homeland Security and Justice for GAO, on May 21, 2013 before the House Subcommittee on Border and Maritime Security, DHS identified 1,901 illegal overstays of concern in 2011. As of March 2013, 14 percent remain missing.

The 1,901 cases were reprioritized for further investigation by DHS “because the subjects of the records could pose national security or public safety concerns.”

Of those that pose security threats, 266 could not be located, and nine individuals had been arrested.

The report said 481 (25.3 percent) of the cases were given to Immigration and Customs Enforcement’s (ICE) Enforcement and Removal Operations (ERO) division, because they presented “potential public safety threats.” ERO is “responsible for identifying and apprehending aliens who are subject to removal from the country, detaining these individuals when necessary, and removing aliens subject to removal from the United States.”

Also, 302 (15.9 percent) of the illegal overstays were in the process of changing their status to continue living in the U.S., and 711 (37.4 percent) had left the country.

The findings are based on a DHS review of a backlog of 1.6 million overstays in the summer of 2011. According to the report, 863,000 cases were removed, having found that the individuals left the country or were in legal status.

Visa overstays pose a significant national security risk, according to Gambler, since one-fourth of the terrorists who carried out 9/11 were in the country illegally, overstaying their visas.

“We have reported that most overstays are likely motivated by economic opportunities to stay in the United States beyond their authorized periods of admission,” Gambler said.  “However, overstays could pose homeland security concerns—for example, 5 of the 19 September 11, 2001, hijackers were overstays.”

Other examples include, Hosam Smadi, a Jordanian national, who overstayed his visa and plotted to blow up a Dallas skyscraper in 2009, and Amine El Khalifi, a Moroccan who was living past his visa since 1999 and was arrested for plotting to bomb the U.S. Capitol last year.

The GAO testimony also revealed that there are currently more than 1 million “unmatched arrival records” in the DHS’s Arrival and Departure Information System (ADIS), or potential cases where immigrants have remained in the country with expired visas.

Furthermore, DHS has failed to report to Congress on visa overstays, as required by law, due to a lack of “confidence in the quality of its overstay data.”  DHS Secretary Janet Napolitano has said, however, that her agency plans to report on overstay rates by December 2013.

Editor’s NotePenny Pritzker – have you heard of her yet? SUA has kept tabs on her since 2008 when her name was originally bandied about as a possible Cabinet Secretary for Commerce back in 2008-09. She was not appointed in 2009 because she had some cleaning up to do in her business life – she had a failed bank issue to resolve.

Now we fast forward to today, and guess what, she is up for that same post again in 2013. We wonder just how all those who lost money at her bank are faring today. We also roll our eyes about the abject hypocrisy of her appointment. She is an extremely rich person; funny how a woman richer than Mitt Romney is the pick when Romney was labeled as being out of touch while running for President.

Obama nominates Penny Pritzker as Commerce Secretary

Then there is that pesky $80 million she forgot to disclose, hmmm, shades of that Tim Geithner type of American – ‘let them eat cake’! $80 million, just an oversight? Ooops!

Obama’s Commerce Secretary Pick Failed to Disclose $80 Million in Earnings

The Secretary of Commerce overseas virtually all of the business and industry that takes place in the US and with other countries.  He/she is responsible for trillions of dollars of business and sales.  That requires someone who not only has an extensive business background, but also someone who is trustworthy and beyond reproach.

Recently, President Barack Obama appointed Penny Pritzker to be the next Secretary of Commerce.  According to their website, the Mission Statement for the Department of Commerce states:

“The U.S. Department of Commerce promotes job creation, economic growth, sustainable development and improved standards of living for all Americans by working in partnership with businesses, universities, communities and our nation’s workers. The department touches the daily lives of the American people in many ways, with a wide range of responsibilities in the areas of trade, economic development, technology, entrepreneurship and business development, environmental stewardship, and statistical research and analysis.”

“To drive U.S. competitiveness in the global marketplace, the Commerce Department works to strengthen the international economic position of the United States and facilitates global trade by opening up new markets for U.S. goods and services. Here at home, the Commerce Department promotes progressive business policies that help America’s businesses and entrepreneurs and their communities grow and succeed. Cutting-edge science and technology at the department fosters innovation, and a focus on research and development that moves quickly from the lab to the marketplace generates progress and new 21st century opportunities. No matter where businesses are in their life cycle, whether just getting off the ground or looking to expand into overseas markets, the Commerce Department is singularly focused on making U.S. companies more innovative at home and more competitive abroad, so they can create jobs.”

“The Commerce Department also provides effective management and monitoring of our nation’s resources and assets to support both environmental and economic health. Through critical weather monitoring, weather forecasts and resource preservation, the department protects not only public safety and security but also our oceans, coasts and marine life while assisting their economic development. Other essential operations conducted by the Commerce Department include the constitutionally mandated decennial census, which serves as the basis of America’s representative democracy, as well as the system by which businesses and innovators secure intellectual property rights.”

The Secretary of Commerce oversees an annual budget of $7.5 billion and 47,000 employees located in the US and abroad.  Does Pritzker meet the qualifications needed to head the Commerce Department?

Pritzker is the founder, chairman and CEO of PSP Capital Partners along with the Pritzker Realty Group.  She is known as an entrepreneur and business executive.  In 2011, she was listed by Forbes 400 to be the 263rd wealthiest person in the United States with a net worth of $1.7 billion.  Pritzker also served as finance chairman for Obama’s 2008 presidential campaign.

From that, it would seem that she is a successful and highly qualified business person who may just be a decent Secretary of Commerce.  However, there are other factors that need to weighed before she receives an approval.

To start with, it has been discovered that she failed to report $80 million in earnings on her disclosure report.  According to reports, the $80 million was earned from consulting on more than 400 domestic trusts involving an intergenerational family feud.  The restructuring involved the Hyatt Hotels, Hyatt Center, Conwood Company, Marmon Corp and Union Tank Car and evidently a number of people were not pleased with Pritzker’s advice and counsel.  She claims it was an oversight that is being corrected.  Gee, I wish I was able to consider $80 million worth of earnings as just an oversight, don’t you?

The national hotel and workers union has expressed opposition to Pritzker’s nomination citing her dealing with the Hyatt Hotel chain.  In a phone interview, Donald Taylor, president of UNITE HERE, the hotel and restaurant workers’ union with 270,000 members said:

“We are opposed to the nomination of Penny Pritzker based on what has taken place at Hyatt.”

Taylor said he has not yet been in contact with AFL-CIO president Richard Trumka concerning their support or opposition to the Pritzker appointment.  The AFL-CIO, one of the largest and most powerful unions in the country has been boycotting the Hyatt Hotel chain ever since the Pritzker assisted restructuring.

It’s interesting that I haven’t heard of any Republicans coming out against the appointment, while strongly Democratic unions are.  Perhaps that should be taken as a positive sign that she may do well if confirmed.  At the moment, I’m not sure which way to vote on her appointment.

HOLDER MUST GO says HuffPo over Fox's Rosen Investigation

Editor’s Note – You know you have really ‘jumped the shark’ when the Huffington Post and NBS report that AG Holder was the one who signed off on the probe into Fox News’ James Rosen and demanded Holder’s head. Is that the fat lady I hear singing? SUA has been demanding Holder’s resignation, impeachment, or arrest for ages, well before Fast and Furious.

TIME TO GO: HOLDER OK’d PRESS PROBE

Attorney General Eric Holder personally signed off on the warrant that allowed the Justice Department to search Fox News reporter James Rosen’s personal email, NBC News’ Michael Isikoff reported Thursday.

The report places Holder at the center one of the most controversial clashes between the press and the government in recent memory. The warrant he approved named Rosen as a “co-conspirator” in a leak investigation, causing many to warn that the Justice Department was potentially criminalizing journalism. The warrant also approved the tracking of Rosen’s movements in and out of the State Department, as well as his communications with his source, Stephen Kim.

Time to go home Mr. Holder, clean out your desk, security will see you to the door. Then await the subpoenas, here they come!

The Justice Department later said that it did not intend to press any charges against Rosen.

The attorney general is usually required to approve requests to search journalists’ materials, but that rule does not extend to email records.
(Holder recused himself from the investigation into the Associated Press, meaning that he absolved himself of that responsibility.) Holder has previously said that he was not sure how many times he had authorized the search of journalists’ records.

The revelation came hours after President Obama said in a speech that he was concerned about the potential implications of the Fox News and AP investigations. Obama said that Holder would be reviewing the department’s rules for investigations that involve reporters.

Fox News chief Roger Ailes responded to the Justice Department’s investigation on Thursday, sending a staff memo condemning the Obama administration’s choices.

“We reject the government’s efforts to criminalize the pursuit of investigative journalism and falsely characterize a Fox News reporter to a Federal judge as a “co-conspirator” in a crime,” Ailes wrote. “I know how concerned you are because so many of you have asked me: why should the government make me afraid to use a work phone or email account to gather news or even call a friend or family member? Well, they shouldn’t have done it.”

Bin Qumu – Why WH is covering on Benghazi?

So many theories abounded on what was going on in Benghazi, especially concerning arms, but here we see Ben Qumu and his al Qaeda affiliations may have been that reason. Why The White House is Dragging Their Feet Re: Benghazi Suspects

Some frustrated voices are starting to come out with information about how the FBI has positively identified a number of suspects who are thought to be behind the attack on the US Consulate in Benghazi on September 11th of last year.  Fox News cites an anonymous Special Operations soldier voicing his frustration, in many ways the frustration of much of America, about the Obama administration’s inaction.  The problem is, we don’t know what we don’t know.

Meanwhile in Libya, many associated with the late Gaddafi regime have been dropping like flies.  The media has been chalking it up to tribal violence, even as non-Gaddafi regime Libyans are targeted, most of them seeming to be killed while inside their vehicles.  Even Ben Qumu, the former Gitmo inmate in charge of Ansar Al-Sharia, the militia primarily behind the Benghazi attack has a bulls eye painted on the back of his head as he dodged an assassination attempt about a month ago.  His right hand man, Yahya Abdel Sayed ate it in Sitre just prior to that.

The leaking of the FBI’s five Benghazi suspects is problematic for the Obama administration in a number of ways.  For one thing, it puts the suspects within the frame of reference of law enforcement, making it essentially impossible to vector in on the suspects for “targeted killings” or even a low-visibility snatch and grab operation which would deliver them to Gitmo.  With the spotlight on them, the only recourse left may be to have them arrested.

But there is another good reason why the Obama administration would prefer to kill those behind Benghazi with a drone strike or by sending in JSOC shooters.  As I’ve written previously, the United States had to kill Osama Bin Laden.  Bringing him to trial was out of the question because of the things he would begin to talk about when put on the stand.  There is no need for conspiracy theory here, just talking about any US support he may have received while fighting the Soviets in Afghanistan during the 1980′s would have been a massive embarrassment for America and American foreign policy.  This is why the Benghazi suspects need to be eliminated from the administration’s perspective, one suspect in particular.

You know where this is going.  One of them received covert US support not long after the Libyan Civil War.  Apparently he had a fairly cordial relationship with the US government, a quid pro quo arrangement.  If the FBI manages to arrest him and bring him to trial it will look like Iran-Contra part two for the Obama administration.  That’s why the suspects, along with Ben Qumu will more than likely quietly disappear.

And everyone knows that a post-conflict environment, filled with tribal violence, and an extremely weak transitional government sets the perfect stage for hiding an assassination.
